1. INTRODUCTIONWelcome to Dr Umesh Cosmetic Care. These Terms & Conditions (“Terms”, “Agreement”) govern your access to and use of the websites, mobile applications, booking engines, and communication channels—including the WhatsApp Official API and Rich Communication Services (RCS) platforms—owned and operated by Dr Umesh Cosmetic Care (“Clinic”, “We”, “Us”, or “Our”), located at Row House-20, Siddhhivinayak Shatrunjay Plaza, Kondwa Budruk, Po: N I B M, Pune, Maharashtra, Pin 411008. By accessing our services, booking appointments, or interacting with our automated communication systems, you agree to be bound by these Terms.

2. DEFINITIONS* “Clinic” refers to Dr Umesh Cosmetic Care, its practitioners, and authorized staff.* “Services” refers to cosmetic care consultations, treatments, procedures, skincare programs, website usage, and transactional updates delivered via automated messaging.* “User” (“You”, “Client”) refers to any individual who accesses our website, registers an account, or opts into our communication channels.* “Channels” refers to official communication routes, specifically the WhatsApp Business API and RCS messaging networks.

1. ACCEPTANCE OF TERMSBy checking any acceptance box, completing a registration form, scheduling a cosmetic procedure, or explicitly opting into our WhatsApp/RCS communication lists, you acknowledge that you have read, understood, and agreed to be bound by this Agreement. If you do not agree to these terms, you must immediately cease using our services and opt out of our communication platforms.

2. DESCRIPTION OF SERVICESDr Umesh Cosmetic Care provides professional cosmetic treatments, consultations, and aesthetic care solutions. We leverage advanced automated communication suites, including the Meta WhatsApp Business platform and carrier-provided RCS services, to send automated booking confirmations, treatment pre-care instructions, post-care follow-ups, billing receipts, and targeted marketing campaigns.

3. ELIGIBILITYYou must be at least 18 years of age to independently register for treatments or subscribe to our messaging updates. If you are under 18, you may only utilize our Services under the supervision and explicit consent of a parent or legal guardian who agrees to be bound by these Terms

4. ACCOUNT REGISTRATION & SECURITYTo book certain specialized treatments or access the digital patient portal, you may be required to provide personal identification details, including your full name, contact number, and email address. You are solely responsible for maintaining the accuracy and confidentiality of your profile details. You must notify us immediately at Umeshphad2016@gmail.com of any unauthorized use of your personal details.

6. PAYMENT & BILLING TERMSAll charges for consultations, clinical cosmetic procedures, and skincare formulations are due as specified at the time of booking or post-treatment. We accept payments via authorized payment gateways, credit/debit cards, UPI, and banking channels. All transactions are processed securely through certified Indian payment aggregators.

7. SUBSCRIPTION RENEWAL & TERMINATIONFor ongoing skincare programs or multi-session treatment packages, renewals are billed on a predefined schedule. Clients may cancel future packages or terminate their communication subscription at any parallel time. Dr Umesh Cosmetic Care reserves the structural right to terminate or suspend access to our Services or block specific telephone profiles from our messaging queues for violation of these Terms.

8. USE OF WHATSAPP OFFICIAL API & RCSBy providing your mobile number (7972174621) on our forms or initiating a chat, you provide explicit, affirmative opt-in consent to receive transactional and promotional messages from Dr Umesh Cosmetic Care via the Meta WhatsApp Business API and RCS network. Standard network data charges may apply based on your mobile carrier. You can revoke this consent at any time by replying with the keyword “STOP” or “UNSUBSCRIBE”.

9. MESSAGE DELIVERY & COMPLIANCE POLICYMessage delivery is subject to efficient transmission by third-party intermediaries, including Meta Platforms Inc., telecom operators, and internet service providers. While we strive to ensure timely delivery of treatment guidelines and booking alerts, the Clinic does not guarantee instant delivery and is not liable for delayed, blocked, or failed message transmissions arising from carrier-side errors or network congestion

10. INTELLECTUAL PROPERTY RIGHTSAll materials displayed across our website and communication modules—including text, graphics, branding, logos, video guides, and treatment software modules—are the exclusive intellectual property of Dr Umesh Cosmetic Care. No content may be copied, modified, distributed, or republished without our explicit written permission.

11. CONFIDENTIALITYDr Umesh Cosmetic Care maintains strict confidentiality regarding all clinical data, treatment histories, and personal discussions. We will not disclose your identity or aesthetic treatment roadmap to unauthorized third parties, except as mandated by relevant law enforcement or within our secure medical processing infrastructure.

12. DISCLAIMER OF WARRANTIESAll cosmetic services, professional opinions, and automated messaging updates are provided on an “as-is” and “as-available” basis. Dr Umesh Cosmetic Care makes no representations or warranties, express or implied, regarding the definitive medical outcomes of cosmetic procedures, as individual biological responses vary.

13. LIMITATION OF LIABILITYTo the maximum extent permitted by applicable Indian law, Dr Umesh Cosmetic Care, its directors, and practitioners shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of our services, unexpected side effects of standard clinical treatments, or any technical disruptions encountered on our WhatsApp and RCS platforms.

14. INDEMNIFICATIONYou agree to defend, indemnify, and hold harmless Dr Umesh Cosmetic Care, its staff, and medical affiliates from and against any third-party claims, damages, losses, liabilities, and expenses arising out of your violation of these Terms, submission of inaccurate medical histories, or misuse of our official communication routes.

15. GOVERNING LAW & JURISDICTIONThese Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of India. Any legal actions, disputes, or proceedings arising out of this Agreement shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra, India.

16. CHANGES TO TERMSWe reserve the right to modify these Terms at any time to align with updated clinical offerings, new Meta compliance policies, or amended Indian telecom rules. The updated date at the top will indicate when changes took effect. Continued use of our services post-updates constitutes dynamic acceptance of the revised Terms.
